GENERAL TERMS AND CONDITIONS (GTC) FOR THE USE OF THE ONLINE SHOP AT WWW.WESTWING.BE
Below, we present our General Terms and Conditions (hereinafter referred to as "GTC"), which form the basis for the use of the Westwing online shop on the website www.westwing.be. By placing your order, you accept the following General Terms and Conditions of Westwing GmbH, Moosacher Str. 88, 80809 Munich, Germany (hereinafter referred to as "Westwing").
These GTC apply to consumers with a billing address in Belgium who take advantage of the offers on our website. A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.
1. GENERAL INFORMATION AND SCOPE
1.1 Westwing operates an online shop on the website www.westwing.be.
1.2 To take advantage of the offers, persons must be at least 18 years of age.
1.3 Goods are generally only sold in normal household quantities.
1.4 These General Terms and Conditions apply to all contracts concluded via the website www.westwing.be, unless the separate B2B General Terms and Conditions for Entrepreneurs apply.
1.5 If deadlines are specified in (working) days, this refers to all weekdays with the exception of Saturdays, Sundays and public holidays.
2. USE OF THE WEBSITE WWW.WESTWING.BE AND REGISTRATION
2.1 When ordering goods, you will be asked to provide personal data, which will be collected and processed in accordance with Westwing's data protection regulations. Clause 19 (Data Protection) applies.
2.2 You are responsible for ensuring that the data is complete and accurate. You are also obliged to keep your data up to date. If there is a change in the data provided during your use of the website, you must correct the information immediately. You are obliged to treat your passwords and any other access data confidentially and to protect them from access by unauthorised third parties.
2.3 You are solely responsible for any content (e.g. product reviews) that you post in areas accessible for this purpose. You guarantee that your own content does not infringe any third-party rights (e.g. personal rights or copyrights). In this regard, you shall indemnify Westwing in full against any third-party claims upon first request. By transmitting the content to Westwing, you grant Westwing and all companies affiliated with Westwing within the Westwing Group (hereinafter "Westwing Group") all simple, temporal, spatially and content- ly unrestricted rights of use, including the right to pass them on to third parties, which Westwing requires in order to publish and distribute the content, even in excerpts, on the websites of the Westwing Group.
2.4 In your customer account, you can view and, if necessary, change your open, recently shipped and/or completed orders, as well as manage and save your own data, vouchers, newsletters and notifications in a differentiated manner.
2.5 You may only register with one customer account on the website www.westwing.be and may only operate one customer account at a time. If Westwing detects multiple registrations, Westwing may delete them.
2.6 It is prohibited to use the website www.westwing.be or its contents for purposes that are illegal, abusive or prohibited by law and these GTC. In particular, technical processes must not be disrupted or manipulated. In the event of behaviour or attempts to gain unjustified advantages to the detriment of Westwing or other customers, Westwing reserves the right to block the customer account and not to accept offers.
2.7 Westwing reserves the right to exercise its virtual domiciliary rights at its own discretion and, for example, to issue warnings, reject orders, restrict the available payment methods, block access to the website www.westwing.be or delete transmitted content if the provisions of these GTC are violated or if there is an abuse of rights. Your right of withdrawal under Section 13 of the GTC is not restricted in any way by the aforementioned measures. Any claims for damages by Westwing remain unaffected by this.
3. CONTRACTING PARTIES, LANGUAGE AND CONCLUSION OF THE CONTRACT
3.1 The contracting party for contracts concluded on the website www.westwing.be is Westwing.
3.2 The website www.westwing.be is operated in Dutch, French, German and English. Contracts via the website are concluded exclusively in Dutch, French or German.
3.3 The offer of goods on www.westwing.be does not constitute a binding offer, but is to be understood as a non-binding invitation to submit an offer. After the selected products have been placed in the virtual shopping basket and the electronic ordering process has been completed, you submit a legally binding contract offer by clicking on the "Buy now" button to place an order for the goods currently in the virtual shopping basket. After submitting your offer, you will receive an email from Westwing confirming receipt of your offer. This email from Westwing does not constitute acceptance of the contract. Westwing reserves the right not to accept offers at its sole discretion. If an order is not executed by Westwing, Westwing will inform you immediately. Acceptance of the contract takes place by means of a separate email with the shipping confirmation, but no later than when the goods are shipped.
3.4 Westwing stores the order data and sends it to you by email after you have completed your order. This email also contains cancellation policy information. You can also view the terms and conditions at any time at https://www.westwing.be/i/terms_and_conditions/. If you have created a customer account before submitting your order, you can view the order details at any time in the login area at. This also applies to past orders within the scope of the statutory retention obligations.
3.5 Orders are usually processed and contact is usually made via automated order processing or by email. You must ensure that the email address you provide for order processing is correct so that emails sent by Westwing can be received at this address. In particular, if you use spam filters, you must ensure that all emails sent by Westwing or third parties commissioned by Westwing to process orders can be delivered.
4. PRICES AND SHIPPING COSTS
4.1 For orders of goods on the website www.westwing.be, the prices stated on the respective item detail page at the time of your order apply. The prices are total prices including statutory value added tax and packaging. Shipping costs and, if applicable, the costs for an additionally bookable assembly service (see section 5) are added to this.
4.2 The product prices in your virtual shopping basket always correspond to the current price on the product detail page. This means that the current product price may differ from the price at which you added the product to your virtual shopping basket. When you add a product to your virtual shopping basket, you are not reserving the price displayed at that time. The price of a product may increase or decrease between the time you add it to your virtual shopping basket and the time you actually purchase it.
4.3 Shipping costs are charged separately for each order and are based on the price indicated on the product detail page. This price is based, among other things, on the size, weight and respective shipping method. The latter is at the discretion of Westwing.
5. ASSEMBLY SERVICE
5.1 For selected products, assembly or installation at the desired location is offered as an additional separate paid service in almost all areas of Belgium (hereinafter referred to as "assembly service"). If you would like the product to be assembled in such a case, you can order the assembly service by ticking the "Assembly service" box on the product detail page, placing the item in your virtual shopping basket and completing the order by clicking on the "Buy now" button.
Westwing does not guarantee that the goods can actually be set up or installed in the rooms intended for this purpose. Westwing reserves the right to refuse to offer the assembly service in individual cases at its own discretion. Assembly is carried out in accordance with the respective assembly instructions.
5.2 Westwing will provide the assembly service itself or through third parties (subcontractors) acting on behalf of Westwing, at your discretion. You are not entitled to choose a specific person to carry out the desired assembly service.
5.3 After placing your order, you will be contacted by Westwing or a Westwing subcontractor to arrange an appointment. To enable the assembly service to be provided, a suitable and easily accessible environment must be ensured and, where necessary, facilitated by reasonable cooperation on your part (e.g. providing access, sufficient space for assembly).
5.4 Painting and wallpapering work and/or electrical installations as well as wall and ceiling installations are excluded from the assembly services.
5.5 When ordering the assembly service, additional costs will be charged on top of the purchase price in accordance with the price displayed when you place your order or on the appointment booking website.
5.6 The risk of accidental loss and accidental deterioration of the goods shall only pass to you after completion of the assembly service and handover of the goods.
5.7 Westwing and its subcontractors are entitled to carry out an acceptance inspection after assembly and to take photographs for documentation purposes.
6. TERMS OF PAYMENT AND PAYMENT
6.1 Subject to our credit check, you can pay for the goods using one of the following payment methods:
PayPal, credit card (VISA, Mastercard, American Express), iDeal, Bancontact, payconiq, ApplePay, GooglePay (only for orders placed via a web browser), Klarna and prepayment.
6.2 Westwing accepts various credit cards, currently: VISA, Mastercard and American Express. Westwing will charge the invoice amount to your credit card after receipt of the order via our payment service provider Stripe Payments Europe Ltd. (registered in the Irish Commercial Register under number 3206488LH).
6.3 The payment methods iDeal, Bancontact, payconiq, ApplePay and GooglePay are processed via the payment service provider Stripe Payments Europe Ltd. (registered in the Irish Commercial Register under number 3206488LH).
6.4 If a payment method offered by PayPal is selected, payment will be processed via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (registered in the commercial register under R.C.S. Luxembourg B 118 349), subject to the PayPal Terms of Use, available at https://www.paypal.com/be/webapps/mpp/ua/useragreement-full.
6.5 Westwing, in cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden (registered in the Swedish Commercial Register under: 556737-0431), also offers you the following payment options, subject to creditworthiness: Purchase on account with payment within 30 days, payment in three interest-free instalments, financing with interest or immediate payment. In this case, Westwing assigns its claim to Klarna.
7. INVOICING
7.1 By accepting the Terms and Conditions, you agree that Westwing will issue invoices to you electronically.
7.2 Please note that if your details are incorrect at the time of ordering in accordance with section 2.2, Westwing cannot issue a corrected invoice to rectify your details after your order has been completed.
8. VOUCHERS
8.1 Westwing offers various types of vouchers: gift cards, promotional vouchers and compensation vouchers:
8.1.1 Gift vouchers
8.1.1.1 Gift vouchers are vouchers that you can purchase on the website and redeem only at www.westwing.be, unless otherwise stated on the gift voucher. The gift vouchers will be sent to you by email after you place your order.
8.1.1.2 Gift vouchers and remaining credit from gift vouchers can be redeemed until the end of the third year after the year of purchase of the gift voucher.
8.1.1.3 Gift vouchers can only be used to purchase goods and not to purchase additional gift vouchers.
8.1.1.4 If the price of your order exceeds the credit balance of a gift voucher, you can pay the difference using the payment methods offered. If the price of your order is lower than the credit balance of a gift voucher, you can redeem the remaining credit balance with your next order.
8.1.1.5 In the event of a contract being rescinded – for whatever reason – the purchase price will be refunded by crediting the voucher account and any additional payment methods used.
8.1.1.6 The gift voucher is transferable.
8.1.1.7 Lost or stolen voucher codes will not be refunded. Westwing accepts no liability for lost voucher codes.
8.1.2 Promotional vouchers (including "Refer-a-friend vouchers")
8.1.2.1 Promotional vouchers are vouchers that are issued free of charge as part of promotional campaigns with a specific period of validity and cannot be purchased by you. Promotional vouchers can only be redeemed on www.westwing.be during the specified period, but not on shipping or assembly costs. Promotional vouchers may be subject to additional individual conditions. These will be communicated to you in direct connection with the voucher.
8.1.2.2 Vouchers that you have received as a new customer based on an invitation from a Westwing member (so-called "refer-a-friend voucher") cannot be redeemed if you already have an account with Westwing, as the voucher is only redeemable for new customers.
8.1.2.3 First-time registration or new customer vouchers that you received once for registering on the website www.westwing.be can only be redeemed once per customer account.
8.1.2.4 Only one promotional voucher can be redeemed per order. A refund or credit for the remaining balance of a promotional voucher is not possible if the value of the purchase is less than the voucher value.
8.1.2.5 The promotional voucher is non-transferable, non-refundable and cannot be redeemed again if you return all or part of the goods or services paid for with the voucher within the statutory right of withdrawal. If you return part of the goods you ordered, the voucher value will be distributed proportionally among the goods ordered, i.e. if individual items are returned, the voucher will be credited proportionally to the price of the returned goods and will expire proportionally to the value of the goods. If a voucher is linked to a minimum order value, this must also be achieved in the case of partial returns, otherwise the voucher value will not be credited.
8.1.4 Compensation vouchers
8.1.4.1 Compensation vouchers are vouchers that cannot be purchased, but are issued by Westwing at its own discretion as compensation without recognition of any legal obligation.
8.1.4.2 The regulations on promotional vouchers apply accordingly.
8.2 Westwing may block the corresponding voucher code (even temporarily) or refuse redemption (even temporarily) if there is reasonable suspicion of fraud or other illegal or conditional actions in connection with the purchase or redemption of a voucher. In the latter case, you have the right to cancel the order.
8.3 It is not possible to pay out the voucher amount, nor is it possible to transfer the value or subsequently offset it against purchases already made, i.e. before the order process was completed.
8.4 The aforementioned vouchers can only be redeemed by consumers.
9. DELIVERY AND SHIPPING CONDITIONS
9.1 Deliveries are only made within Belgium to the delivery address you have provided.
9.2 The standard delivery times are indicated on the respective item detail page.
9.3 The ordered goods will be shipped either as a parcel or by freight forwarder, at Westwing's discretion.
9.4 Westwing does not assume any procurement risk, especially in the case of a generic purchase. Westwing is only obliged to deliver from its existing stock or from goods ordered from suppliers. Westwing's delivery obligation shall not apply if, despite an existing covering transaction with the respective supplier, Westwing does not receive delivery, does not receive complete delivery or does not receive delivery on time and is not responsible for this, Westwing has informed you of this immediately and a separate procurement risk has not been expressly agreed. Any advance payments shall be refunded by Westwing.
9.5 Westwing cannot be held liable for the non-fulfilment or defective fulfilment of the obligations entered into by Westwing under this contract if and to the extent that this is due to the occurrence of force majeure, notwithstanding the fact that Westwing will do everything in its power to minimise the consequences of such an event.
Force majeure means any unforeseen events which, even if they were foreseeable, are beyond Westwing's control and whose effects on the performance of the contract could not have been prevented by reasonable efforts on the part of Westwing. These include, but are not limited to, war, war-like conditions, riots, rebellion, military or civil coups, uprisings, tumult, riots, embargoes, official orders, fire, floods, storm surges, hurricanes or other storms of catastrophic proportions, earthquakes, lightning strikes, pandemics, epidemics, nuclear hazards or similar reasons beyond Westwing's control that make the fulfilment of the obligations set out in these GTC illegal, impossible or economically unfeasible. If a case of force majeure occurs, Westwing is obliged to inform you immediately. Westwing is released from its obligation to perform for the duration of the event. The delivery and performance deadlines are extended accordingly. If the force majeure lasts longer than 8 weeks, Westwing and you are entitled to withdraw from the contract.
9.6 If the delivery of the goods fails for reasons for which you are responsible, Westwing will charge you for the costs of a new delivery and reasonable storage costs from the day of the unsuccessful delivery. You will also be charged for the costs of a new delivery if the first delivery was free of charge for you. We will inform you of the additional costs before the new delivery and will only carry out the delivery with your consent. Please note that refusal to accept delivery does not constitute an effective exercise of the right of withdrawal and must be expressly declared to Westwing. Westwing reserves the right to withdraw from the contract if you do not approve a new delivery within 7 days. In this case, Westwing will refund any payments you have already made. This also applies if you effectively exercise your right of withdrawal. In this case, you will also be refunded the shipping costs (standard shipping).
10. WARRANTY, LIABILITY AND TRANSPORT DAMAGE
10.1 We ensure that our goods correspond to your order and meet the normal expectations you have, taking into account the nature of the product.
We apply the statutory minimum warranty period of two years if the goods do not correspond to the order. This means that in the event of conformity defects, the legal remedies provided for by law apply.
Claims for damages are excluded. This does not apply to claims for damages resulting from injury to life, limb or health or from the breach of essential contractual obligations (cardinal obligations) as well as liability for other damages based on an intentional or grossly negligent breach of duty by Westwing, its legal representatives or vicarious agents. Essential contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract. In the event of a breach of essential contractual obligations, Westwing shall only be liable for foreseeable damage typical for this type of contract if this was caused by simple negligence.
The aforementioned limitations of liability shall not apply if Westwing has fraudulently concealed the defect or has assumed a further commercial guarantee for the goods.
Claims for damages due to obvious material defects in the delivered goods are excluded if you do not notify us of the defect within a period of two weeks after delivery of the goods. Claims for damages due to conformity defects in the delivered goods are excluded if you do not notify us of the defect within a period of two months after discovering the defect.
The following restriction applies to contracts for the delivery of used goods: The limitation period for claims for defects is one year from delivery of the goods if this has been expressly and separately agreed in the contract and you have been specifically informed of the shortened limitation period before submitting your offer.
All goods and services will be delivered to the address you provided when placing your order.
We take the utmost care when accepting and executing product orders and when assessing requests for the provision of services.
If delivery is delayed or an order cannot be fulfilled or can only be partially fulfilled, we will always inform you before the planned delivery date expires. If we fail to do so, you may cancel your order free of charge. In this case, we will refund the amount within 30 days of cancellation.
Our shipments are always at our risk until the time of delivery to you or a representative designated by you. However, if you return goods to us within 30 days of purchase because you do not wish to keep them, you are responsible for the transport.
If the goods we deliver are damaged during transport, do not match the items listed on the delivery note or do not match the items you ordered, you must report this as soon as possible and return the items to us, at the latest within two weeks of delivery.
We cannot be held responsible for consequential damages resulting from late or non-delivery by the carrier we have commissioned. In such cases, our liability is limited to the value of the items that can be proven not to have arrived at the customer.
10.3 If the goods are delivered with obvious damage to the packaging or contents, please report this immediately to the delivery company concerned and contact Westwing Customer Service (service@westwing.be). This notification does not affect your warranty rights, but it does make it easier for Westwing to enforce its claims against the delivery company.
11. GUARANTEES
An additional warranty only exists if it is expressly stated and described on the product detail page.
12. RIGHT OF WITHDRAWAL FOR CONSUMERS
You have the right to withdraw from this contract within fourteen (14) days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or e-mail). You can use the following model withdrawal form for this purpose, but this is not mandatory:

To comply with the withdrawal period, it is sufficient that you send the notification of your exercise of the right of withdrawal before the expiry of the withdrawal period.

The right of withdrawal does not apply or expires in the case of the following contracts:
for the delivery of goods that are not suitable for return for reasons of health protection or hygiene and whose seal has been removed after delivery or which, due to their nature, have been inseparably mixed with other goods after delivery;
for the delivery of goods that are manufactured according to customer specifications or clearly tailored to personal needs
for the delivery of goods that can spoil quickly or whose expiry date would be quickly exceeded.
13. CONSEQUENCES OF REVOCATION
If you have revoked the purchase contract, we shall reimburse you for all payments we have received from you, including delivery costs, without delay and at the latest within fourteen (14) days from the day on which we received notification of the revocation of the contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you. In no event will you be charged for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return the goods immediately and in any case within fourteen (14) days of the day on which you notify us of the cancellation of the contract to the following address:

The deadline is met if you send the goods before the expiry of the fourteen-day period. We will bear the costs of returning the goods. You will only be liable for any loss in value of the goods if this loss in value is attributable to handling that is not necessary for testing the condition, properties and functionality of the goods.
14. VOLUNTARY RIGHT OF RETURN FOR CONSUMERS
14.1 In addition to the statutory right of withdrawal in accordance with Section 12, Westwing grants you a voluntary right of return for all purchases of goods for a total of 30 days from receipt of the goods. This voluntary right of return allows you to withdraw from the purchase contract even after the 14-day withdrawal period (see Section 12) has expired by returning the goods to Westwing within 30 days of receipt.
However, in order to exercise the voluntary right of return, you must return the goods to in their entirety, in perfect condition and without damage, in their original sales packaging. Otherwise, Westwing reserves the right to refuse the return. Please note that you bear the transport risk when returning goods under the voluntary right of return. The voluntary right of return does not apply to the purchase of gift vouchers.
14.2 The refund will be made to the payment method you used for payment. If direct debit was chosen as the payment method, no objection to the direct debit is required.
14.3 Your statutory right of withdrawal (see section 12) is not affected by compliance with the conditions set out in this section 14 and continues to apply independently of this. Until the expiry of the period for the statutory right of withdrawal, only the statutory conditions specified therein shall apply. This contractually granted (voluntary) right of return does not restrict your statutory warranty rights, which remain unrestricted.
15. REIMBURSEMENT OF DELIVERY AND SERVICE COSTS IN THE EVENT OF PARTIAL REVOCATION
If you revoke the contract for only part of the goods in an order (partial revocation), Westwing will refund you the payments for the goods covered by the revocation, including delivery and assembly costs (if not yet assembled). However, if the delivery and assembly costs would have been incurred (in part) even if you had only ordered the goods for which you did not cancel the contract, these are excluded from the refund.
16. RETENTION OF TITLE
The goods remain the property of Westwing until full payment has been received.

18. DISCLAIMER FOR HYPERLINKS
Insofar as www.westwing.be refers to websites of other providers via hyperlinks, Westwing has no influence on their content, does not adopt them as its own and accepts no guarantee or liability for their content. The respective provider or operator of the pages is always responsible for the content of these pages. As soon as Westwing becomes aware of legal violations on websites of other providers, the corresponding hyperlinks on www.westwing.be will be removed immediately.

20. RIGHTS OF USE
The content of this website, including text, graphics, photos, illustrations, images, videos, sounds and software (hereinafter referred to as "material") is protected by copyright. Downloading or use for private purposes is permitted. Further publication, distribution, reproduction or other use of the content/material is not permitted.
All rights of use to the material on www.westwing.be are held by Westwing or our partners. Use of the material in any form whatsoever is not permitted without the express written approval of Westwing.
All trademarks used on the website may not be used without the prior written approval of Westwing.
21. ALTERNATIVE DISPUTE RESOLUTION
Westwing GmbH is not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.

22. CHANGES TO THE TERMS AND CONDITIONS
Westwing reserves the right to make changes to the website, rules and regulations, and terms and conditions, including these Terms and Conditions, at any time. Your order is subject to the Terms and Conditions valid at the time of your order, unless a change to these Terms and Conditions is required by law or regulation (in which case they also apply to orders you have placed previously).
23. FINAL PROVISIONS
23.1 All disputes arising from or in connection with the use of www.westwing.be are subject exclusively to Belgian law, excluding the provisions of the UN Convention on Contracts for the International Sale of Goods.
23.2 Should any provision be or become void or ineffective, the remaining provisions shall remain effective. The relevant statutory provisions shall apply in place of the void or ineffective provisions.
